Recent FDA Authorization Is Bold Action By Trump Administration To Protect Youth and Our Communities

With the FDA’s recent authorization of dozens of new electronic nicotine delivery systems (ENDS) products for marketing in the U.S., the Trump Administration has shown strong leadership to address the varied challenges in the nicotine market. With this action, the Administration has created a clear, science-based pathway for the proven products that help adult smokers quit, while drawing a bright line against the illegal alternatives from China that have flooded store shelves and hurt law-abiding small businesses. 

That bright line only means something if it's enforced. CUSP has long raised the alarm about the unregulated vapes from China. Those illegal products, largely peddled by bad actors who exploited an inconsistent enforcement landscape under previous administrations, don't just undercut American manufacturers, they deliberately target kids. Strong enforcement at the local, state, and federal levels will send an unambiguous message: the U.S. market is closed to those who refuse to play by the rules.

CUSP has previously applauded the Administration's broader youth protection efforts, including the Surgeon General's Youth Vaping Resource Guide and the enforcement priorities outlined in the Make Our Children Healthy Again report. And as a growing number of states pass their own illegal vape laws, CUSP urges state leaders to demand the FDA release the $200 million already allocated for state and local enforcement and put it to work.
