Stop Illegal Disposable Vapes from China!

Nearly 90% of disposable vapes are made in Shenzhen, China, and most of these vapes are flavored with candy flavors that make them attractive to kids and young smokers.

These Chinese manufacturers are taking advantage of lax FDA enforcement protocols to ship these illegal products to the U.S. with no regulatory oversight, where they have flooded American store shelves and led to a youth vaping epidemic that has seen disposable vape use climb by over 2600% since 2019 among middle and high schoolers.

With little to no enforcement at the Federal level, responsible retailers and wholesalers often do not have the information they need to comply with FDA regulation. As a result, states are taking the initiative the White House won’t.

Directory Laws will hold these shady manufacturers accountable. Most proposed directory bills are modeled after current cigarette directory laws, and will require vape manufacturers to do the following in order to have their products sold in the state:

⏺     Register with the State

⏺     Certify their products are compliant with federal and state laws

⏺     Pay a fine if they are found in violation of these requirements

These proposed directory laws will arm retailers and distributors with the knowledge they need to avoid these illegal vapes, and give state law enforcement a mechanism to enforce sanctions on those who won’t comply.
